These general terms and conditions of sale govern the relationship between, on the one hand, PARTISAN COLLECTOR PARIS, registered with the Paris trade and companies registry under number 848 681 672, owner of the site www.partisancollector.com, whose head office is located at 4 rue Doudeauville, 75018 - Paris (France) hereinafter referred to as "PARTISAN COLLECTOR PARIS" and, on the other hand, the person making a purchase, hereinafter referred to as "the Customer".
GENERAL CONDITIONS
The website www.partisancollector.com was designed by PARTISAN COLLECTOR PARIS, owner and holder of all rights relating thereto. In the absence of prior written authorisation from PARTISAN COLLECTOR PARIS, it is prohibited to copy or download all or part of the Site or its content.
The products offered on the site are described in product sheets including some with photos and indicate their name, colour and characteristics. The photographs and images illustrating the site and the description of the products are not contractual. Under no circumstances may PARTISAN COLLECTOR PARIS be held liable.
These T & Cs may be modified at any time and without notice by PARTISAN COLLECTOR PARIS. The applicable Terms and Conditions are those in force on the date of the order by the Customer.
ORDERS
The www.partisancollector.com site is a showcase website ; it is therefore not possible to place an order on the site.Consequently, the Customer has no right of withdrawal.
The products presented on the site www.partisancollector.com are unique Arts and Crafts items. The products on the www.partisancollector.com website constitute presentation models which are not sold through the site. For any information on the availability of the the aforementioned models, please e-mail : contact@partisancollector.com
Any Customer wishing to buy a product may proceed as follows:
– EITHER the desired item is available and is presented to the Customer in person if possible, or an event (pop-up shop, exhibition, showroom, etc.) and purchased on site.
– OR either the desired item is not available and the Customer can order it and customise it to specifications ideally made during a meeting in person. The manufacturing will be customised to the wishes of the Customer.
The order can also be placed e-via email, mail (sending samples of materials), telephone or remotely by video.
In the case of a customised order, PARTISAN COLLECTOR PARIS reserves the right to refuse combinations of materials or colours either for technical reasons or for non-conformity with the brand image. Similarly, some countries refuse or make it very difficult to import certain materials (leathers), which thereby limits the Customer's choices.
Any order will result in a dated and signed quotation bearing the phrase 'agreed and signed' and followed by a signature. Any signed quotation legally binds the Customer.
The Customer must ensure the accuracy and completeness of the mandatory personal data they provide. By signing the quotation, the Customer acknowledges their legal capacity. For minors, the signature of a parent or guardian is compulsory. Any quotation signed by the Customer constitutes the conclusion of the sales contract and correspondingly acceptance of : price, description, quantity of the products for sale, estimated delivery times and all clauses in these general terms and conditions of sale.
PARTISAN COLLECTOR PARIS has a contractual obligation only after receipt of 50% of the price of the item within a maximum period of 8 days following the signature of the quotation by the Customer.
PARTISAN COLLECTOR PARIS will then confirm the acceptance of the order to the Customer by email no later than 48 hours after receipt of payment.
NB: PARTISAN COLLECTOR PARIS reserves the right to refuse to make a delivery or to honour an order from a Customer with whom PARTISAN COLLECTOR PARIS has a legal dispute, in particular concerning payment.
PRICE
The price of each item takes into account the rarity of the materials chosen and the manufacturing time. The time required to produce the item varies depending on the design and the materials chosen. Any project gives rise to a precise quotation.
Prices of available existing products are given on request, in euros including all taxes but excluding shipping costs.
All orders, whatever their origin are payable in euros.
PARTISAN COLLECTOR PARIS reserves the right to modify its prices at any time. The products will be invoiced at current prices at the time of receipt of the signed quotation.
VAT EXEMPTION:
As PARTISAN COLLECTOR PARIS is registered as a micro-enterprise, it is exempt from VAT. The latter is therefore not applicable to the products it sells (art. 293 B of the french general tax code).
For all deliveries outside the European Union (Switzerland included), VAT exemption is applied according to article 262-I-1 of the french general tax code.
For any VAT exempt delivery in France, the VAT exemption is applied according to article 275 of the CGI.
For any intra-community VAT exempt delivery, the VAT exemption is applied according to article 265-ter-1 of the french general tax code.
AVAILABILITY OF MATERIALS AND MANUFACTURING TIMES
In accordance with the principle of the circular economy, PARTISAN COLLECTOR PARIS wishes to use only existing materials by selecting leathers from over-production or dormant stocks of tanneries or large fashion houses. Consequently, PARTISAN COLLECTOR PARIS can only make a limited selection of materials available to its Customers prior to researching a supplier of the Customer's chosen materials. For customised orders, if the material chosen by the Customer is not available when they place an order, PARTISAN COLLECTOR PARIS will offer to postpone the order until the chosen material is obtained or to replace it with another which suits their specifications.
The manufacturing time for a customised order is between 1 and 3 months. This period runs from the date of receipt of the deposit and after signature of the quotation and acceptance of the estimated delivery date.
DELIVERY
PARTISAN COLLECTOR PARIS favours the hand delivery of the products to the address chosen by the Customer in Paris and the Paris region (free service).
In other cases, the product can be delivered by a carrier at the customer's expense.
In the latter case, PARTISAN COLLECTOR PARIS cannot be held liable in the event of delay or delivery error due to incorrect entry of the address by the Customer when the order was placed.
In order for these deadlines to be respected, the Customer must ensure that they have provided their exact and complete delivery address (for ex: street, building, staircase number, access codes, names and/or intercom numbers, etc.).
Deliveries made outside mainland France may be subject to taxes and customs fees which will be the sole responsibility of the Customer.
The costs of transporting the products, and any customs fees owed by the Customer in addition to the price of their order will be brought to the Customer's attention on the quotation.
Delivery by carrier will only be made after receipt of the balance of the price. For hand delivery, payment must be received no later than the day of delivery.
Delivery by carrier is made to the delivery address specified by the Customer, which must be either their place of residence, that of a natural person of their choice or a legal person (delivery to a company). Delivery may not be made to hotels or PO boxes (unless by express agreement between PARTISAN COLLECTOR PARIS and the Customer).
The carrier delivery times will be indicated solely for reference and PARTISAN COLLECTOR PARIS is not liable for the consequences of a delay in delivery caused by a third party.
REPORTING OF DEFECTS and RETURNS PROCEDURE
The Customer must check the condition of the products on delivery and, if necessary, make handwritten comments describing any defects/damage/missing elements (open package, damaged product etc.) on the carrier's delivery slip and sign it.
The Customer must refuse delivery if the goods are damaged, missing, or if the package has been opened or repacked (except for passage through customs) and request for the package to be returned to the sender.
In all cases, the Customer must inform PARTISAN COLLECTOR PARIS of the defects/damage/missing elements on the same day or at the latest within 3 days of delivery by email at contact@partisancollector.com with the description of the defects/damage/missing elements and a photo of the product and the packaging.
When the goods are accepted unconditionally by the Customer and/or when PARTISAN COLLECTOR PARIS is not notified of any claim within 3 days of delivery, the goods are deemed to have arrived in good condition and in full.
If the product has to be returned to PARTISAN COLLECTOR PARIS by either the initial carrier, another carrier of your choice or you personally,it must imperatively be sent back with its original packaging, especially if it has been repackaged.
The determination of defects/damage/missing elements of returns in relation to the original state of the product and packaging is solely at the discretion of PARTISAN COLLECTOR PARIS, in particular if it appears clearly, upon receipt of the package, that the deterioration in condition claimed is not related to transport or manufacturing, or that the package is returned incomplete.
If the return is refused by PARTISAN COLLECTOR PARIS for the reasons stipulated above, the product(s) will be returned to the Customer at the latter's expense without the latter having recourse to any compensation or right to reimbursement, with the exception of the subsequent exercise of the warranty rights on the products sold. Please note that the Customer would be liable for the cost of returning products to PARTISAN COLLECTOR PARIS .
If after receipt and verification of the damaged product, PARTISAN COLLECTOR PARIS accepts the claim, PARTISAN COLLECTOR PARIS will offer the Customer either a refund or a new similar item (depending on the availability of materials). PARTISAN COLLECTOR PARIS will then make a claim against the carrier; the Customer undertakes, however, to provide all information necessary for implementing the guarantee.
PARTISAN COLLECTOR PARIS would be liable for return costs.
PAYMENT
In the case of a customised order, the Customer pays a deposit of 50% to confirm their order ; the balance must be paid no later than the day of delivery by hand or the scheduled day of shipment.
In the case of the purchase of an available item, the customer must pay the full price of the product on the day delivery by hand or on the day of shipment.
PARTISAN COLLECTOR PARIS will only dispatch the order when the balance has been received. The total payment and the dispatch notice will then be emailed to the Customer.
- Payment by bank transfer
PARTISAN COLLECTOR PARIS's bank details for making the transfer are specified on the quotation. The Customer is liable for any transfer costs.
- Payment via Paypal
Payments can also be made by Paypal, a secure payment service by bank card.
The order will be sent to the Customer upon receipt of payment by PARTISAN COLLECTOR PARIS. The applicable delivery times run from the date of receipt of payment and may therefore be modified accordingly from those mentioned on the day the order was placed.
Invoices are issued upon receipt of full payment and emailed to the address specified on the quotation.
Once the Customer has confirmed their order by signing the quotation, PARTISAN COLLECTOR PARIS reserves all of the products or materials selected for a period of 8 days. Beyond this deadline, if the PARTISAN COLLECTOR PARIS has not received payment, the products or materials are put back on sale.
LEGAL GUARANTEES
The products sold by PARTISAN COLLECTOR PARIS are subject to the legal guarantees provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees :
- Legal guarantee of conformity:
PARTISAN COLLECTOR PARIS will deliver a product in conformity with the contract and free from conformity defects when the said product is delivered, in the sense that the product will be suitable for the use usually expected of a similar item and that it will have the characteristics presented at the moment of sale.
Guarantee exceptions: PARTISAN COLLECTOR PARIS cannot be held liable for damage caused by the Customer in connection with their use or natural wear and tear of the products.
The products are entirely made of leather. Each skin is unique and has its own specificities of colour, natural markings (fine lines, veins, pores) which make it unique and cannot be considered as defects.
During manufacture of the products, certain seams are hand- sewn by leather craftsmen. The finishes and the seams may therefore present some variations or irregularities.
This guarantee is only valid within two years of delivery of the product. Any lack of conformity that appears within twenty-four (24) months of delivery is presumed to have existed at the time of delivery, unless proven otherwise.
You can choose between repairing or replacing the product unless either of these choices involves a disproportionate cost for PARTISAN COLLECTOR PARIS. If repair or replacement of the product is impossible (for example due to unavailable materials), you may be reimbursed and return the product or keep the product and be partially reimbursed, unless the defect is minor. The return, replacement or reimbursement of the product will be made at no cost to the Customer and does not preclude the possible awarding of damages in the event that you are entitled thereto.
The guarantee covers all defects of metallic materials or parts and manufacturing defects in the context of normal and ordinary use of the product by the Customer. This guarantee does not apply in the event of damage resulting from tearing, neglect, carrying of excessive weight, prolonged exposure to the sun or water, impacts, poor maintenance or conservation. Similarly, damage due to normal wear and tear and the ageing of any natural material is not covered by the guarantee.
- Legal guarantee against hidden defects:
PARTISAN COLLECTOR PARIS gives the Customer a product free of hidden defects which would make it unfit for the use for which it is intended, or which so reduce this use, that the Customer would not have purchased it, or would only have purchased it at a lower price, if the Customer had been aware of them. This guarantee will is only valid on the condition that the Customer makes the claim within two (2) years from the discovery of the defect.
In the event of a hidden defect, the Customer will have the choice of returning the product and having the price and costs incurred by the purchase reimbursed or keeping the product and having part of the price reimbursed. In all cases, it is incumbent on the Customer to prove that they meet the conditions of the guarantee.
In case of lack of conformity and hidden defects, the Customer must return the products to us at the following address: PARTISAN COLLECTOR PARIS - 4 rue Doudeauville - 75018 Paris.

LIMITATION OF LIABILITY
In no case shall PARTISAN COLLECTOR PARIS be held liable for any damage which does not result from a failure of PARTISAN COLLECTOR PARIS to fulfill of its obligations.
Before purchasing, the customer must ensure that the materials of the product do not contain elements harmful to their health.
PARTISAN COLLECTOR PARIS is not liable for possible "computer screen/reality" colour difference. The photographs illustrating the products on the site www.partisancollector.com are not contractual.
PARTISAN COLLECTOR PARIS cannot be held liable in the event of a stock shortage, late delivery, strike (including transport) or force majeure and, more generally, for any event that is not exclusively caused by it.
The client accesses, uses and browses the PARTISAN COLLECTOR PARIS website at their own risk.
CUSTOMER SERVICE
All technically repairable products are covered by customer service. For any repair, please contact our customer service.
A quotation will be provided.
In accordance with article L 111-3 al 1 of the French Consumer Code, PARTISAN COLLECTOR PARIS states that no period of availability for product spare parts is guaranteed. PARTISAN COLLECTOR PARIS will nevertheless make every effort to satisfy its Customers in the event of a request for one or more spare parts.
